In her recent article ‘Moral Responsibility Without Libertarianism’, Lynne Rudder Baker contends that libertarian intuitions can be accommodated by compatibilist conditions for moral responsibility. She proposes a principle called the ‘Reflective Endorsement View’ which she believes is capable of achieving this end. The Reflective Endorsement View holds that once an agent reflectively identifies with his actions in a particular way, he is morally responsible for those actions, irrespective of whether he has the power to do otherwise or the cause of (...) the action ultimately originates in him. I contend that Baker’s compatibilist Reflective Endorsement View is too stringent and exclusive for moral responsibility. I argue this on the basis that the very intuitions that led Baker to formulatethe various conditions that must be satisfied for moral responsibility can be used to show the inadequacy of her position. Abstract:This article puts forth the thesis that the contractualist account of moral justification affords a powerful reply in business contexts to the question why a business person should put ethics above immediate business interests. A brief survey of traditional theories of business ethics and their approaches to moral motivation is presented. These approaches are criticized. A contractualist conception of ethics in the business world is developed, based on the work of John Rawls and Thomas Scanlon. The desire to justify our (...) choices in terms that others can be reasonably expected to accept, or at least in terms that others cannot reasonably reject, is identified and differentiated from other accounts of motivation. It is this desire that constitutes the core motive to be moral in business on the contractualist conception. Implications of this contractualist conception for the theory and practice of business ethics are then discussed. (shrink)

According to Hume, no knowledge attainable by human beings would ever justify rational belief in recurrent physical properties and causal effects. He arrived at this conclusion because he denied the possibility of knowing--but not the reality of--either the 'inner natures' or the 'secret powers' of objects which would enable one to intuit or to demonstrate a 'necessary connection' between the internal structures of objects and their observable properties, or between the causal powers of entities and their effects. The (...) purpose of this article is to show that while Hume's scepticism was justifiable in his day given the generally accepted limitations then of scientific inquiry and explanations, it no longer is reasonable in light of later scientific discoveries and theories. To a degree to which no eighteenth-century philosopher or scientist could anticipate, experimental inquiry has disclosed the inherent natures of objects and the underlying causes of phenomena that attest to the interconnectedness of physical reality and thus justify, at least to some extent, our instinctive beliefs in the uniformity of nature and predictability of events. Times of heightened risk to the physical safety of their citizens inevitably cause democracies to recalibrate their institutions and processes and to reinterpret existing legal norms, with greater emphasis on security, and less on individual liberty, than in "normal" times. This article explores the ways in which the American courts have responded to the tension between civil liberties and national security in times of crises. This history illustrates that courts have rejected both of the two polar positions that characterize public (...) discourse on these issues. Civil libertarians argue that political bodies are too easily gripped by passions, hysteria, and self-interest in these times and that courts therefore ought to play a central role in protecting liberty. Executive unilateralists argue that the qualities that uniquely characterize the executive branch, such as decisiveness, access to information, and efficiency, must become so dominant in these moments that few checks, if any, should constrain executive prerogatives. Oddly, civil libertarians and executive unilateralists find implicit consensus in the view that, in times of war, courts have tended not to play a significant role in overseeing executive power. We argue to the contrary: historically, a significant constitutional tradition of judicial scrutiny in the United States during times of war does exist. But this scrutiny does not take the form of courts making first-order substantive judgments about the content of liberty or other claimed constitutional rights. Nor does it take the form of judicial assessment of how significant or credible the national security claims of the executive branch might be. Instead, judicial oversight has been focused on preserving the institutional structures and processes through which decisionmaking on these issues takes place. The judicial role has centered on the second-order question of whether the right institutional processes have been used to make the decisions at issue, rather than on what the content of the underlying rights ought to be. This approach has historically rejected or resisted most claims of executive unilateralism. When courts have upheld the government's actions, they have done so only after a judgment that Congress, as well as the executive, has endorsed the action. This approach has also rejected the civil libertarian framework. When courts find bilateral institutional endorsement, they have typically accepted the joint political judgment of how liberty and security tradeoffs ought to be made. By focusing on congressional endorsement of emergency measures, the courts have created a broad-based political accountability for the actions taken in the name of national security. We suggest that even if congressional endorsement is more apparent than real in some of these contexts, the judicial maintenance of this structure of rhetorical justifications sustains desirable understandings of political structure. Because the President and Congress draw from different political constituencies in a presidential rather than a parliamentary system, we also raise questions about whether the American judicial approach to these questions should be limited to political systems with separated executive and legislative powers. Managerialism is not mere ideology, a concatenation of ideas subsisting in an epiphenomenal superstructure (Überbau) that mirrors economic relations (Base) and masks interests, but a set of practices that, as an extreme manifestation of human resources management (HRM), seeks to constitute the life-world (Lebenswelt) of participants in many sectors of society. Increasingly, it is those at the extremes of elite wealth and marginal poverty who may fall outside its remit and become free to think beyond its parameters. As inheritor of (...) personnel management, HRM as practice and ideology fills a societal vacuum and comes to exercise the power of totalizing social construction. In an integral performance culture the Performative Absolute emerges in the imaginary; it is an immanent sublime that instantiates and regulates the social being of the individual. This apotheosis of the 'manager's right to manage' overrides boundaries between public and private spheres and dissolves the separation of powers. As 'human resource', the employee is subject to living sacrifice; this is an oblation that demands ethical and theological critique. (shrink)

Rather it is with two seemingly minor questions. Accepting his circumscription of religion as "the dimension of depth," we would be interested to see if within or beside a Theology o] culture, a Theology o] religion would also be possible, having as its subject religious expressions under and outside the authority of the Gospel. The selections from the treatises, sermons, and letters are well arranged and contain several new translations into English by competent scholars. Both the editor's exposition and Augustine's own efforts to face the basic issues created by the meeting of diverse systems of doctrine and language enable the student to become aware of the amazing range of Christian philosophy created by a man who was both a busy bishop and an inquisitive truth-seeker. This is the third edition of a classic book first published in 1960, which has sold thousands of copies in two paperback edition and has been translated into several foreign languages. Popkin's work ha generated innumerable citations, and remains a valuable stimulus to current historical research. In _The Company We Keep_, Wayne C. Booth argues for the relocation of ethics to the center of our engagement with literature. But the questions he asks are not confined to morality. Returning ethics to its root sense, Booth proposes that the ethical critic will be interested in any effect on the ethos, the total character or quality of tellers and listeners. Ethical criticism will risk talking about the quality of _this_ particular encounter with _this_ particular work. Yet it will (...) give up the old hope for definitive judgments of "good" work and "bad." Cambridge: Harvard University Press, 1996) argued that universities have abandoned their original project of promoting a national culture and have tried to substitute by embracing globalization, but the vagueness and incoherence of the concept has failed to return purpose to the University. The academic treatment of corporate social responsibility illustrates this dilemma. For a generation after H.R. Bowen (Social Responsibilities of the Businessman. New York: Harper & Row, 1953) founded the field, scholars struggled to fit (...) the concept within a national system of pluralistic power-sharing among a variety of institutions that would define and enforce standards of responsibility necessary for the general good of American society. That understanding changed in the nineteen eighties, shortly after corporate executives had united to an unprecedented degree to direct the power of government in their interests, influence the public agenda, and roll back the power of unions. In response, business ethicists began to reformulate corporate social responsibility as a voluntary practice on the part of these same executives. Since the Kantian and Lockean principles upon which this approach was based were themselves problematic, it is not surprising that the experience gained over the last generation casts doubt on the efficacy of this reliance on voluntary restraint and personal initiative. However, circumstances that include the failure of globalization to deliver on its promises may have changed sufficiently in recent years to revive interest in approaches that acknowledge the importance of countervailing power for encouraging greater corporate social responsibility. Parallels in anatomy between humans and domesticated mammals suggest that for the last 300,000 years, Homo sapiens has experienced more intense selection against the propensity for reactive aggression than any other species of Homo. Selection against reactive aggression, a process that can also be called self-domestication, would help explain various physiological, behavioral and cognitive features of humans, including the unique system of egalitarian male hierarchy in mobile hunter-gatherers. Here I review nine leading proposals that could potentially explain why self-domestication occurred (...) in H. sapiens, whether by selecting in favor of cooperation and tolerance or by selecting against aggressiveness. To account for the domestication syndrome, proposals must explain what led to a decline in fitness of highly aggressive males, and why the explanatory factor applies only to H. sapiens rather than to other species of Homo. The proposed explanations invoke genetic group selection; group-structured culture selection (also known as cultural group selection); social selection by female mate choice; social selection by male partner choice; increased self-control; cooperative breeding; high population density; use of lethal weapons; and language-based conspiracy. Most proposals face difficulties in accounting for the origins and/or maintenance of self-domestication. I conclude that the evolution of language-based conspiracy, which is a form of collective intentionality, was the key factor initiating and maintaining self-domestication in H. sapiens, because it is the most convincing mechanism for explaining the selective pressure against individually powerful fighters. Sophisticated language enabled males of low fighting prowess to coordinate in executing physically aggressive and domineering alpha males. This system is known today as a leveling mechanism in small-scale societies. Group-structured culture selection possibly accelerated the process. (shrink)

In the world according to Hume, people are complicated creatures, with convoluted, often contradictory characters. Consider, for example, Hume's controversial assessment of Charles I: "The character of this prince, as that of most men, if not of all men, was mixed .... To consider him in the most favourable light, it may be affirmed, that his dignity was free from pride, his humanity from weakness, his bravery from rashness, his temperance from austerity, his frugality from avarice .... To speak the (...) most harshly of him, we may affirm, that many of his good qualities were attended with some latent frailty, which, though seemingly inconsiderable, was able, when seconded by the extreme malevolence of his fortune, to disappoint them of all their influence: His beneficent disposition was clouded by a manner not very gracious; his virtue was tinctured with superstition; his good sense was disfigured by a deference to persons of a capacity inferior to his own; and his moderate temper exempted him not from hasty and precipitate resolutions." This sketch shows Charles in all his complexities, with his virtues, near virtues, and contradicting virtues. I have quoted it at length because it is hard to summarize without losing the subtleties that lie within it. Public health is concerned with increasing the health of the community at whole. Insofar as health is a ‘good’ and the community constitutes a ‘public’, public health by definition promotes a ‘public good’. But ‘public good’ has a particular and much more narrow meaning in the economics literature, and some commentators have tried to limit the scope of public health to this more narrow meaning of a ‘public good’. While such a move makes the content of public health less controversial, (...) it also strips important goals from the realm of public health, goals that traditionally have been, and morally should be, a part of it. Instead, I will argue, while public health should be defined by public goods, it should be defined by a broader conception of public goods that I shall call ‘normative public goods’, goods that ought to be treated as if they were public goods in the more narrow sense. Many of the standard arguments against neuroenhancements—that they are unsafe, that they violate the distinction between therapy and enhancements, that they undermine equality, (...) and that they will be used coercively—fail to show why the use of any such technologies is wrong in principle. Two other objections—the arguments that such changes undermine our integrity and that they prevent us from living authentic lives—will condemn only a few of the uses that are proposed. The result is that very few uses of these drugs are morally suspect and that most uses are morally permissible. (shrink)

David Hume is an ardent supporter of the practice of religions toleration. For Hume, toleration forms part of the background that makes progress in philosophy possible, and it accounts for the superiority of philosophical thought in England in the eighteenth century. As he puts it in the introduction to the Treatise: “the improvements in reason and philosophy can only be owing to a land of toleration and of liberty”. Similarly, the narrator of part 11 of the First Enquiry comments.

Adam Lucas has written another excellent book on medieval history and technology. His approach follows in many ways those of John Langdon and Richard Holt, whose influence he graciously acknowledges. Lucas also continues their challenge to older theories about water-powered mills. What his study adds to theirs is a considerable additional number of medieval monastic and ecclesiastical communities and their mills, most of these located in parts of England much less studied earlier. Thus, he adds considerably to our overall (...) knowledge of milling resources available in England after Domesday and the varied costs of using water- and wind-powered mills. Indeed, religious toleration represents one of the key accomplishments of the culminating event of Hume’s History of England: the Glorious Revolution of 1688. -/- Yet even though religious toleration forms the background of philosophy in general—or perhaps just because it does so—Hume offers precious few arguments for it, and they are, for the most part, given implicitly rather than as formal argu­ ments. Nevertheless, we can distinguish three different, though interrelated, lines of support for toleration in Hume’s thought: (i) an argument based on a general skepticism; (ii) an argument based on a contempt for organized religion; and (iii) a pragmatic argument based on the need for peace and orderly government. From our point of view, what is striking about all of these argument is how un-Lockean they are: Hume does not rely on the idea of a fundamental conceptual separation of church and state, nor on a natural right to freedom of conscience that character­izes writers working in the Lockean tradition. However, of the arguments he gives, only the last, I will argue, has any hope to provide a useful case for toleration. (shrink)
